How we use cookies (the technical bit)

1. About Us

We are Altalix Ltd. Our registered office is at Rise London, 41 Luke Street, Shoreditch, London, England, EC2A 4DP. Our company number is 10408510.

We are registered with the Information Commissioner's Office (ICO) the UK data protection regulator, to use personal information. Our registration number is ZA486407.

Altalix is committed to safeguarding and respecting your privacy. The firm will always keep your information safe and private; never sell your information; and allow you to manage and review your marketing choices at any time.


2. The Importance of Reading this Notice

Altalix will collect personal information when you use our website ( www.app.altalix.com); the Altalix app; or any of the services you can access through the website or app (our services).

Under data-protection law, we are what is known as the 'data controller' of your personal information.

This policy contains important information

This document explains what information we collect, how we use it, and your rights if you want to change how we use your personal information.

3. Your Personal Information

Altalix collects various types of information from you and others.

Altalix collects information on you when you:

  • complete any forms;

  • correspond with us;

  • register with Altalix;

  • open an account or use any of our services;

  • take part in online discussions, surveys or promotions;

  • speak or chat with a member of our customer support team (either on the phone or through the Altalix app or website);

  • enter a competition; and

  • contact Altalix for other reasons.

3.1. Altalix will collect the following personal information:

  • Your name, address, and date of birth.

  • Your email address, phone number and details of the device you use (for example, your phone, computer or tablet).

  • Your username, password and other registration information.

  • Details of your bank account, including the account number, sort code and IBAN.

  • Details of your debit cards and credit cards, including the card number, expiry date and CVC (the last three digits of the number on the back of the card).

  • Your cryptocurrency addresses.

  • Identification documents (for example, your passport or driving licence number), copies of any documents you have provided for identification purposes, a personal description (if you provide one), and any other information you provide to prove you are eligible to use our services.

  • Records of our discussions, if you contact us or we contact you.

  • Your photo (only if you upload one).

3.2. Altalix will collect the following information from your device, whenever you use our website or app:

  • Technical information, including the internet protocol (IP) address used to connect your computer to the internet, your log-in information, the browser type and version, the time-zone setting, the operating system and platform, the type of device you use, a unique device identifier (for example, your device's IMEI number, the MAC address of the device's wireless network interface, or the mobile phone number used by the device), mobile network information, your mobile operating system, the type of mobile browser you use and so on.

  • Information about your visit, including the links you have clicked on, through and from our site (including date and time), services you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling and clicks), and methods used to browse away from the page.

  • Information on transactions (for example, payments into and out of your account), including the date, time, amount, currencies, exchange rate, beneficiary details, details of the merchant or ATMs associated with the transaction, IP address of sender and receiver, sender's and receiver's name and registration information, messages sent or received with the payment, details of device used to arrange the payment and the payment method used.

  • Information stored on your device, including if you give us access to contact information from your address book, log-in information, photos, videos or other digital content, check-ins (sometimes, we call this content information). Altalix will regularly collect this information in order to stay up to date.

3.3. Altalix will collect information about your location. If you have location services in the Altalix app switched on, we track your location using GPS technology and your IP address.

3.4. Alatlix collects information from third parties (others), such as credit reference agencies, fraud prevention agencies, crypto forensic experts and partners who help us provide our services. This includes your credit record; information and analysis to help us check your identity; and information and analysis relating to your transactions.

3.5. Altalix collects information from social media, if you permission us to do so. This includes friends lists from Facebook or similar information from other online accounts. If you've asked us to, we'll use your Facebook profile to confirm your identity as part of our know-your-client (KYC) process (the process of how we check who you are).

Business Customers

If you are a business user, we will need to confirm your identity as part of our KYC process. We will ask you to provide documents, and will also collect information from third parties, such as commercial registers, for this purpose.

We may also collect any of the above information relating to your use of the Altalix Dashboard, the Altalix app and our website.


4. Altalix's Legal Basis for using Your Information

Altalix's legal basis for using your personal information will be one of the following.

4.1 Keeping to our contracts and agreements with you - We need certain personal information to provide our services and cannot provide them without this information.

4.2 Legal Obligations - In some instances, we have a legal responsibility to collect and store your personal information (for example, under money-laundering laws we must hold certain information about our customers).

4.3 Legitimate Interests - We sometimes collect and use your personal information, or share it with other organisations, because we or they have a legitimate reason to have it and this is reasonable when balanced against your right to privacy.

4.4 Consent - Where you've agreed to us collecting your information, for example by using the Altalix app; Altalix's services in general; or when you have ticked a box to indicate you are happy for us to use your personal information in a certain way.

In the next section, we explain in more detail how we use your personal information.


5. How Altalix uses Your Information

Altalix collects your information so we can provide the best service, tell you about products and services you may be interested in, and meet our legal obligations.

5.1 Providing Altalix Services - Whenever you apply for a product or service, we will use your personal information to check your identity (as part of our KYC process) and decide whether or not to approve your application.

If you are already a Altalix customer, we use your personal information to meet our obligations relating to any transactions you make (for example, making payments into and out of your Altalix account, withdrawing cash or making payments with your Altalix Card). If you ask us to exchange the currency of the e-money you hold in your Altalix account, we'll use your personal information to help us do that.

We also use your personal information to give you details of our products and services and to help us develop new products and services.

We also use your personal information to contact you by phone and provide you with customer support services. We may record these calls, but only for internal training and quality-control purposes.

Examples of how Altalix uses your Personal Information to Provide Our Services

Credit Products – if you apply for a credit product, Altalix or our lending partner (the provider of the product) will carry out a credit check for the purposes of better understanding your financial circumstances and repayment history.

Increased Trading Limits – if you apply for, for example, increased trading limits, Altalix may (amongst other possible actions) request and use personal information to prove declarations you may have previously made (e.g. address; check provenance of your funds; and perform a background check (e.g. criminal record, PEPs and sanctions, adverse media etc).

The types of information we use are: information you have provide to us and information from third parties (as explained in the section 3.1 above).

Altalix's legal basis would be one of the following:

  • Keeping to contracts and agreements between you and us

  • Legitimate interests (we need to be efficient about how we meet our obligations and we want to provide you with good products and services)

  • Legal and Regulatory duties

5.1 Protecting against Fraud – Altalix uses your personal information to check your identity to protect against fraud, keep to financial-crime laws and to confirm that you are eligible to use our services. We also use it to help us better understand your financial circumstances and manage fraud risks related to your Altalix account.

The types of information Altalix uses are as follows:

  • information you have provided;

  • information from your device;

  • location information; and

  • information from third parties.

Example of how Altalix uses your Personal Information to Protect Against Fraud

Altalix analyses your personal information and prior activity to identify suspicious transactions.

Altalix's legal basis would be one of the following:

  • Keeping to contracts and agreements between you and us

  • Legitimate interests (we need to be efficient about how we meet our obligations and we want to provide you with good products and services)

  • Legal and Regulatory duties

5.2 Marketing and providing new products and services that might interest you

Altalix uses your personal information to do the following:

  • Provide you with information about other goods and services we offer that are similar to those you have already used or asked about.

  • Provide you with information about our goods or services, and our partner's promotions or offers, which we think you might be interested in. To help us do this, we may use information about you to help us better understand your interests. You can opt out of this by using the help service through the Altalix app or by emailing our Data Protection Officer at the address given above.

  • If you agree, allow our partners and other organisations to provide you with information about their goods or services.

  • Measure or understand the effectiveness of our advertising, and provide relevant advertising to you.

  • Process applications for products and services available through us, and make decisions about whether to approve applications.

Remember, you can ask us to stop sending you marketing information by adjusting your marketing choices (the How do you use my information for marketing? Section 7 below explains how to do this).

The types of information Altalix uses are:

  • information you have provided;

  • information from your device;

  • location information; and

  • information from third parties.

Example of how Altalix uses your Personal Information For Marketing

If you are an Altalix customer, we may contact you about optional extras or promotional offers. We may use information we gather about you through your use of our services to tailor these offers to you.

Our legal basis would be one or both of the following:

  • Legitimate interests (to develop our products and services, define types of customers for new products or services, and to be efficient about how we meet our legal and contractual duties)

  • Consent (for you to receive marketing from other organisations)

5.3 To keep our Services Up and Running

We use your personal information to manage our website and the Altalix app, (including troubleshooting, data analysis, testing, research, statistical and survey purposes), and to make sure that content from our website is presented in the most effective way for you and your device. For more information, please see our Cookies Policy .

We also use your personal information to allow you to take part in interactive features of our services, to tell you about changes to our services, and to help keep our website and the Altalix app safe and secure.

The types of information we use are:

  • information you have provided; and

  • information from your device.

Example of how Altalix uses your Personal Information to Run our Services

If any changes to our services affect you, we will normally contact you using the email address you provided when you signed up, or through the Altalix app, to inform you of the changes.

The legal basis would be one or both of the following:

  • Keeping to contracts and agreements between you and us

  • Legitimate interests (to be efficient about how we meet our obligations and keep to regulations that apply to us)

5.4 Helping with Social Interactions

Altalix uses your personal information to help social interactions through our services or to add extra functions in order to provide a better experience.

The types of information we use are:

  • information you have provided;

  • information from your device; and

  • location information.

Example of how Altalix uses Your Personal Information for Social Interactions

We'll let you know if any of your contacts who are Altalix customers have used our products, upgrades or features or are in the same area as you (if they have location services switched on).

If you have the relevant settings in the Altalix app switched on, we'll use the contact list on your phone, or your photo gallery, so you can easily make payments to your contacts and send photos using the Altalix app.

The legal basis would be one or both of the following:

  • Legitimate interests (to develop our products and services and to be efficient in meeting our obligations) and/or

  • Consent (to track you when you have location services switched on).

5.5 Providing Location-based Services

Altalix uses your information to provide relevant advertising to you (for example, information on nearby merchants), to protect against fraud, and to let you know when any of your contacts who are Altalix customers are in the same area as you (if they have location services switched on).

The types of information we use are:

  • information you have provided and

  • location information.

Example of how Altalix uses Your Location Information

If you go abroad, the Altalix app may automatically tell you the exchange rate in that country.

The legal basis would be at least one of the following:

  • Keeping to contracts and agreements between you and us;

  • Legitimate interests (to develop and market our obligations and keep to regulations that apply to us); and/or

  • Consent (to track you when you have location services switched on).

5.6 Meeting our Legal and Regulatory Obligations; enforcing Altalix's Rights and Other Legal Issues

We may need to share information about you:

  • with other organisations (for example, fraud-prevention agencies);

  • if this is necessary to meet our legal obligations or in connection with legal claims; or

  • to help detect or prevent crime.

The types of information Altalix may share include:

  • information you have provided;

  • information from your device;

  • location information;

  • information from third parties; and

  • social-media information.

Our legal basis would be at least one of the following:

  • Legitimate interests (to keep to laws and regulations that apply to us)

  • Legal obligations

  • Consent (for you to receive marketing from other organisations)


6. Does Altalix carry out credit checks or make any automated decisions about me?

Our lending partners use credit-reference agencies to carry out credit checks on you if you apply for one of their credit products. We will need to carry out credit checks if you apply for any of our credit products, but we will let you know before we do this.

We may also check your credit history to help us develop and offer credit products that are tailored to you. Credit-reference agencies will not store any of your information that we send them when we use their services for this purpose.

These checks of your credit history (credit insights) mean that when you apply for credit products, or we suggest credit products to you through the Altalix app, we can better understand your financial circumstances and repayment history, and can tailor our credit products to your needs. These credit insights do not leave any 'footprint' (trace) whatsoever on your credit record held by the credit-reference agency. If you do not want us to carry out credit insights, please contact us by emailing dpo@Altalix.com.

Some of the searches we make when you apply for a credit product leave a 'soft footprint' on your credit history. This means that the search will be registered on your credit file but will not be visible to others if they search your credit history. (Basically, you will be able to see this footprint but other people won't. See here for more information.) A soft footprint will not affect your credit rating. If you apply for credit, we will provide more information about this in the application form.

Some of our third-party providers, such as fraud-prevention agencies, may also use credit-reference agencies to help us check your identity and prevent fraud. These searches also only leave a soft footprint credit history.

We do not accept joint account holders, but credit-reference agencies may sometimes link your credit record with that of anyone else who is financially connected to you.

Due to the international nature of our services, we use credit-reference agencies and fraud-prevention agencies in the UK and overseas.

Sometimes you may have a right to see your personal records held by credit-reference and fraud-prevention agencies. If you would like details of the credit-reference and fraud-prevention agencies we use, please contact us through the Altalix app or by sending an email to dpo@altalix.com.

You can withdraw your permission for credit checks by contacting us through the Altalix app.


7. How do you use my information for marketing?

If you sign up to our services, we will assume you want us to contact you by post, email and phone (including text message) with offers and promotions. We may use the information we have collected about you in order to tailor our offers to you.

You can adjust your preferences, or tell us you don't want to hear from us, at any time. Just use the 'Privacy' section within the 'Profile' section of the Altalix app or click on the unsubscribe links on any marketing message we send you.

We won't pass your details on to any organisations outside the Altalix group of companies for their marketing purposes without your permission. You can find out more in the Do you share my information with anyone else? Section 10.

8. What are My Rights ?

Your right

What it means

You have the right to be told about how we use your personal information.

We provide this privacy notice to explain how we use your personal information.

You can ask to see the personal information we hold about you (this is called making a 'data subject access request', or DSAR for short). You can also ask for information about what information we process and why.

If you make a DSAR, we will provide a copy of the personal information we hold about you. We can't give you any information about other people, information which is linked to an ongoing criminal or fraud investigation, or information which is linked to settlement negotiations with you. We also won't provide you with any communication we've had with our legal advisers.

You can ask us to correct your personal information if you think it's wrong.

You can have incomplete or inaccurate information corrected. Before we update your file, we may need to check the accuracy of the new information you have provided.

You can ask us to delete your personal information.

You can ask us to delete your personal information if:

  • there's no good reason for us to continue using it;

  • you gave us consent (permission) to use the information and you have now withdrawn that consent;

  • you have objected to us using the information;

  • we have used the information unlawfully; or

  • the law requires us to delete the information.

Just to let you know, we may not be able to agree to your request. As a firm authorised by the Financial Conduct Authority, we must keep certain customer information for at least six years (we've explained this in more detail below). If you've closed your Altalix account, we may not be able to delete your entire file because these regulatory responsibilities take priority. We will always let you know if we can't delete your information.

You can object to us processing your personal information for marketing purposes.

You can tell us to stop using your personal information for marketing.

You can object to us processing other information (if we are using it for legitimate interests).

If our legal basis for using your personal information is 'legitimate interests' and you disagree with us using it, you can object.

However, if there is an overriding reason why we need to use the information (for example, legal reasons), we will not accept your request.

If you object to us using information which we need in order to provide our services, we may need to close your account as we won't be able to provide the services.

For example, if you object to us sending your personal information to our partners such as concierge providers (as part of our Premium and Metal plans), we may no longer be able to provide you with those concierge services.

You can ask us to restrict how we use your personal information

You can ask us to suspend using your personal information if:

  • you want us to investigate whether it is accurate;

  • our use of the information is unlawful but you do not want us to delete it;

  • we no longer need the information, but you want us to continue holding it for you in connection with a legal claim; or

  • you have objected to us using your information (see above), but we need to check whether we have an overriding reason to use it.

You can ask us to transfer personal information to you.

If you have given us any consent we need to use your personal information, you can withdraw your consent at any time by changing your settings in the Altalix app or sending an email to dpo@altalix.com .

(Note, it will have been lawful for us to use the personal information up to the point you withdrew your permission).


9. How to exercise Your Rights ?

To exercise any of your rights set out in the previous section, you can contact us through the Altalix app or send us an email at dpo@altalix.com.

For security reasons, we can't deal with your request if we are not sure of your identity, so we may ask you for proof of your ID.

If you are unhappy with how we have handled your personal information you can complain to the ICO through their website.


10. Does Altalix share my information with anyone else?

10.1 Altalix group companies

We share your personal information within the Altalix group of companies in order to provide you with the best service.

10.3 Partners who help provide and offer access to Altalix Services

We may share your personal information with our partners in order to provide you with certain services you have asked us for.

Example of how Altalix might share Your Information with Our Partners

If you on-board or access our services via the platform of one of our partners (eg Your cryptowallet or Your Exchange provider), Altalix may share Your personal Information with this partner so that they can fulfil their own regulatory and legal obligations.

Altalix will only share your personal information in this way if you have asked for the relevant service. You can withdraw your permission at any time by contacting us through the Altalix app or through the help centre. However, this may affect your ability to continue to use those services.

From time to time we may work with other partners to offer you co-branded services or promotional offers, and we will share some of your personal information with those partners. We will always get your consent before sharing your information for these purposes. You can withdraw your consent at any time by contacting us through the Altalix app.

Our partners will have their own privacy notice explaining how they use your personal information. It's important that you read those privacy notices as well.

10.4 Credit-reference agencies

If you apply for a credit product, we'll share your personal information with credit-reference agencies to check whether you are likely to make repayments when due.

10.5 For Legal Reasons

We also share your personal information with fraud-prevention agencies to check your identity, protect against fraud, keep to anti-money-laundering laws and confirm that you are eligible to use our products and services.

Example of how Altalix might share Your Information for Legal Reasons

If you give us false or inaccurate information and we identify fraud, we will let fraud-prevention agencies know. Law-enforcement agencies may check and use this information.

If fraud is detected, you could be refused certain services, finance or employment. You can contact us through the Altalix app to ask for more details of how your information will be used by us and these fraud-prevention agencies.

Some fraud-prevention agencies have created a document to explain how they use and share your information you can see this here .

Altalix may also need to share your personal information with other third-party organisations:

  • if we have to do so under any law or regulation;

  • if we sell our business;

  • in connection with criminal or fraud investigations;

  • to enforce our rights (and those of customers or others); or

  • in connection with legal claims.

Example of how Altalix might share Your Information for Advertising Purposes

Altalix may share your information (your name, email address and app events) with our advertising partners in the ways described below, but the information is hashed before we send it, and the social-media platform we share it with is only allowed to use that hashed information in the ways described below.

When we use social media for marketing purposes, your information may be shared with the social-media platforms so that they can check if you also hold an account with them. If you do, we may ask the advertising partner or social-media provider to:

  • use your information to send our adverts to you, because we think that you might be interested in a new Altalix product or service;

  • not send you our adverts, because the marketing relates to a service that you already use; or

  • send our adverts to people who have a similar profile to you (for example, if one of our services is particularly useful to people with similar interests to the ones on your social-media profile, we may ask our advertising partner or social-media partner to send our adverts for that service to those people).

An example of how Altalix may use social media for marketing purposes is through Facebook's 'Custom Audience' tool, the terms of which are available here .

The legal basis would be the following.

You can contact us as at any time, either through the Altalix app or by emailing dpo@altalix.com, if you do not want us to share your personal information for marketing purposes. Remember you can also manage your marketing preferences directly with any social-media provider that you have an account with.

11. Will Your Information go outside Europe?

As we provide an international service, we may need to transfer your personal information outside the European Economic Area (EEA) in order for us to provide our services.

For example, if you ask to make an international payment, we will send funds to banks overseas. We might also send your information overseas to keep to global legal and regulatory requirements, and to provide ongoing support services.

We may share your personal information with credit-reference agencies and fraud-prevention agencies outside the UK. (You can read more about this in the Do you carry out credit checks or any make any automated decisions about me? section above).

We will take all reasonable steps to make sure that your personal information is handled securely and in line with this privacy notice and data-protection laws.

12. How Altalix protects Your Personal Information

We store your information on our secure servers.

Any payment transactions carried out by us or our payment-processing providers will be encrypted using Secured Sockets Layer technology or a secure virtual private network.

If you use a password for the Altalix app or our website, you will need to keep this password confidential. Please do not share it with anyone.

Unfortunately, providing information online is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee that all information you provide through the Altalix app or our website will be secure. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

When you use our services, which include social networking, chat room or forum features, do not share any personal information that you don't want to be seen, collected or used by other users, as this information will become publicly available.


13. For how long will Altalix keep Your Personal Information?

Under anti-money-laundering laws we need to hold information about you and your transactions for five years.

You have the right to redeem (ask us to return) your e-money for up to six years after your Altalix account is closed. We will therefore hold your information for this long.

Generally, we will not hold your personal information for more than six years after our business relationship with you has ended, unless we need to hold it for longer because of a potential or ongoing claim or another legal reason.


14. How Altalix will keep You updated on its use of Your Personal Information

If we change the way we use your personal information, we will update this notice and, if appropriate, let you know by text message, by email, through the Altalix app or through our website.

We use cookies to analyse how you use our website. Please read the Altalix Cookies Policy for more information about cookies.

Terms and Conditions

Section 1: Introduction, Definitions and Protocol

1.1. The Terms of Service (the “Terms”) constitute a framework agreement between you (the “User”, “you” or “your”) and Altalix Ltd (“Altalix”). This company is incorporated in England and Wales with company number 10408510. Altalix’s registered office is at Rise London, 41 Luke Street, Shoreditch, London, England, EC2A 4DP. Altalix is registered with the UK Financial Conduct Authority (UK FCA) as a Small Electronic Money Institution with the corresponding firm registration number: 900696.

1.2. It is Altalix’s policy to prohibit and actively prevent money laundering: any of its auxiliary activities; terrorist financing; and/or crime. Altalix is subject to regulation designed to combat money laundering and terrorist financing as set out in all applicable legislation.

Altalix policy accounts for a wide range of anti-money laundering legislation and guidance, including but not limited to: the Financial Action Task Force (“FATF”) regulations and guidelines; JMLSG Guidance Notes; the UK’s Money Laundering, Terrorist Financing and Transfer of Funds Regulations 2017, the Money Laundering Regulations 2007; the Proceeds of Crime Act 2002 (as amended by the Crime and Courts Act 2013 and the Serious Crime Act 2015); the Terrorism Act 2000 (as amended by the Anti-Terrorism, Crime and Security Act 2001, the Terrorism Act 2006 and the Terrorism Act 2000 and Proceeds of Crime Act 2002 (Amendment) Regulations 2007; Canada’s Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA); the US Bank Secrecy Act 1970 and the US Patriot Act 2001; the Asia-Pacific Group on Money Laundering Guidelines; Singapore’s Corruption, Drug Trafficking and Other Serious Crimes (Confiscation of Benefits) Act: the Organised Crime Act 2015: the Mutual Assistance in Criminal Matters Act; Japan’s Act on Punishment of Organised Crimes and Control of Crime Proceeds (Act No. 136 of 1999) (the Act on Punishment of Organised Crimes); and the Act on Prevention of Transfer of Criminal Proceeds (Act No. 22 of 2007); Australia’s Proceeds of Crime Act 2002, the Anti-money Laundering and Counter-terrorism Financing Act 2006; and the Financial Transaction Reports Act 1988.

1.4. Altalix additionally reviews other regulatory authorities’ guidance and internationally accepted regulations to prevent money laundering and to combat terrorist financing.

1.5. Altalix strictly and rigidly implements a comprehensive and thorough KYC and AML compliance framework. This includes monitoring of suspicious transactions and obligatory reporting to local regulators, compliance bodies and law enforcement.

1.6. Altalix reserves the right to refuse registration to persons from jurisdictions that do not meet international AML standards and/or Know Your Customer (“KYC”) policies.

1.7. Altalix AML and KYC policies are as follows:

  1. Transactions executed on the Altalix platform will be subject to AML transaction monitoring;

  2. Identity and proof of address documents and transaction records will be maintained for at least six years and will be submitted to regulators as required without prior notification to registered users;

  3. Altalix may at any time without liability and without disclosing any reason, suspend Your account. Altalix shall notify you after exercising its rights under sections 1.8 and 4.5.

1.8. Altalix reserves the right to carry out Altalix Account-holder diligence verification of users and their transactions. Enhanced Account-holder review may be carried out periodically at our discretion as part of ongoing risk assessment. In addition, any attempt to abuse Altalix or its platform will result in immediate account suspension and reporting violations to the appropriate authorities.

Section 2: Commencement, Term and Your Altalix Account

2.1. The Terms will become LIVE on the day the Altalix confirms to you that your account has been approved and will continue until terminated, in accordance with section 4. Altalix will verify your identity through the documentary means and/ or non-documentary means you provide to Altalix upon registering for an Altalix Account. Altalix reserves the right to use non-documentary means where necessary to verify the true identity of the Altalix Account-holder. To verify the identity of the Altalix Account-holder, Altalix may ask you for a copy of your Government-issued proof of identity (passport copy or driving licence or Government-issued National Identity Card), as well as proof of the Altalix Account-holder’s residential address (electricity, gas, water or fixed landline phone bill less than 3 months old or bank statement) or may request any other document evidencing these.

2.2. As a condition of Verification and Your use of Altalix Services and Your entry into any Altalix transaction, Altalix reserves the right to require You to provide supporting documentation, information and/or photographs and/or require from You real-time facial recognition through the Website or Altalix App, as applicable, as we may reasonably request from you to comply with our regulatory obligations. You acknowledge that where you fail to provide such information or to satisfy such facial recognition, Altalix may take such steps as it deems necessary to prevent your use of the Altalix Services. These Terms incorporate by this reference any Supplemental Terms as may be applicable to your use of Altalix Services from or in your Territory.

2.3. Altalix may confidentially verify the information you provide to us or which we obtain ourselves or through third-parties from secure databases. Some of the searches which we or a third-party may perform, such as a credit check, may leave a soft footprint on your credit history. This will not affect your credit rating. By entering into these Terms, you confirm that you consent to us or a third party on our behalf carrying out such verifications.

2.4. Altalix is NOT currently providing You with an electronic money service. Your Altalix Account is a collection account into which You can deposit money and observe balances of Your wallet within the Dashboard. Your money is deposited and stored in segregated accounts, until Altalix has the reasonable expectation that you may perform a transaction. (See clause 5.4 below). Your wallet balance may be used to purchase cryptocurrency and can only be withdrawn to your own external account. It cannot be transferred to third-party accounts.

2.5. Your funds that are held by Altalix differ from a Bank holding your money in that:

  1. Altalix cannot invest or lend these funds;

  2. Your wallet balance will not accrue interest;

  3. Your money is NOT covered by the Financial Services Compensation Scheme (FSCS); and

  4. Your funds will be held in one or more segregated accounts separate from Altalix’s own funds, except temporarily in the instance outlined in clause 5.4.

2.6. Altalix can only be topped up from an account or card held in Your own name, that is connected to the Altalix Account.

2.7. Altalix is NOT a custodian of cryptocurrency.

2.8. You may be required to provided supplemental information to Altalix in order to unlock further functionality and/or raise limits.

2.9. You are responsible to ensure that the information on your Altalix Account is always accurate and up to date. If at any time we believe that your information is outdated or inaccurate, we may contact you and request further information or request that you go through the verification process again. Your Altalix Transaction Limit will be adjusted accordingly while we verify your identity. Altalix is not be liable for any losses arising out of your failure to maintain up to date information.

2.10. The currencies that You can hold are subject to change.

2.11. Altalix may suspend any or all of Your product access for reasonable security grounds or reasonable suspicions pertaining to unauthorised and/or fraudulent use. You will be informed of such action in accordance with Altalix’s internal policies.

2.12. You are required to declare and provide proof that You are over the age of eighteen and that you have provided correct Information during the process of creating an Altalix Account and that you are an individual acting solely on your own behalf and are not acting for a purpose related to a trade, business or profession. You undertake that, if your details change, you will notify us immediately. You agree and acknowledge that Altalix shall not be liable for any losses that occur due to the submission of invalid, incorrect or inaccurate Information. You agree to cooperate with all requests made by us or any of our third-party service providers on our behalf in connection with your Altalix Account, to identify or authenticate your identity or validate your funding sources or Altalix Transactions. This may include, but is not limited to, asking you for further information that will allow Altalix to reasonably identify you, including requiring you to take steps to confirm ownership of your phone number or payment instruments or verifying your Information against third party databases or other sources as we choose.

Section 3: Account closure

3.1. Your Altalix Account will be closed at the end of the term of this agreement in accordance with Clause 2.1. You accept that after this event Altalix will retain Your personal data for six years.

3.2. If Your Altalix Account holds a balance at the time of closure, Altalix may ask You to withdraw funds within a reasonable timeframe and during this period your account will only be accessible for this purpose. Once this period has elapsed, You will have a further six years to contact customer service and request your funds either by card refund or bank transfer. When the Altalix Account is closed, any pending transactions will be cancelled.

3.3. You are not permitted to close your account during an investigation. Any such attempt may lead to Altalix freezing the account.

3.4. You remain liable for any obligations relating to Your Account even after closure.

Section 4: Termination

4.1. Altalix retains the sole and discretionary right to terminate these Terms by giving You two months’ notice. This will not affect any of Altalix’s rights or your obligations under these Terms.

4.2. You are entitled to terminate these Terms by providing Altalix with one month’s notice. This may be served at support@altalix.com.

4.3. Without prejudice to any rights arising in these Terms, or any party’s other rights or remedies, either party may terminate these Terms with immediate effect by giving written notice to the other party where:

  1. The other party materially breaches any matter in the Terms and fails to remedy the breach within 30 days of written notification;

  2. The other party through repeated breaches demonstrates its inability or lack of intention to affect the Terms;

  3. The other party is subject to bankruptcy, insolvency, winding up or another similar event; and/or

  4. the result of laws, payment scheme rules, regulatory authority rules or guidance or any change in or any introduction thereof (or change in the interpretation or application thereof) means that it is unlawful or contrary to any such law, rules, order or regulations for either of the parties to perform or give effect to any of its obligations hereunder and such obligation cannot be readily severed from these Terms.

4.4. Without prejudice to any rights under these Terms, Altalix may at any time terminate these Terms with immediate effect by written notice if:

  1. Altalix is unable to verify your details in the manner laid out in these Terms;

  2. You die;

  3. Altalix reasonably perceives any risk to its platform;

  4. Altalix reasonably determines that you act to undermine or omit to act in a way to mitigate Altalix’s business operations, reputation and/or goodwill;

  5. Altalix’s reasonably suspects the emergence of an offence and augmented risk or liability; and/or

  6. A third party undermines our ability to serve you under the Terms.

4.5. Altalix may, at its discretion, also suspend your account; share you details with legitimate (as defined by Altalix) regulatory authorities, law enforcement agencies, and/or government departments; and/or if appropriate pursue damages from You.

4.6. Termination means the closing of your Altalix Account in accordance with clause 3.2.

Section 5: Third-Party Providers

5.1. In order to Top-Up Your Altalix Account, you will need to perform a Top-Up via a Stored Card, or via a User Bank Transfer or via a Third-Party Bank Transfer or any other method we make available to you occasionally. Altalix is not responsible for the performance of such third-parties.

5.2. Altalix Service may be available through and/or linked to selected third party Exchanges, websites, Apps, wallets and other Third-Party services. Such Third-Party Services are independent from the Altalix Service. You hereby acknowledge that Altalix has no direct control or authority over such Third-Party Services, and consequently acknowledge and agree that Altalix is not responsible for the availability and performance of Third-Party Services. Altalix does not endorse and is not responsible or liable for any goods, services, content, advertisements, products, or any materials available on and/or through such Third-Party Services.

5.3. You further recognise and agree that Altalix is neither responsible nor liable, directly or indirectly, for any damage; loss regardless of type or origin; opportunity cost; alleged to be caused, by or in connection with use of or reliance on any goods, services – including the custody of cryptoassets, content, products or other materials available on or through any Third-Party Providers and/or Exchanges. Most Exchanges and Third-Party Services provide legal documents, including terms of use and privacy policies, governing the use of each such Third-Party Services and Exchanges, their contents and services. Altalix encourages You to read these legal documents carefully before using or relying upon any such Third-Party Provider or Exchange.

5.4. If Altalix has the reasonable expectation, that You will imminently perform a transaction that may be facilitated by pre-funding accounts at Third-Party Providers, Altalix may temporarily transfer Your funds to the Third-Party in reasonable anticipation of such transactions. An example of such a transaction, would be a cryptocurrency purchase where Your funds may be temporarily moved to an Exchange. (Please see Section 15 below for more on Cryptocurrency and corresponding risks).

Section 6: Altalix Transactions

6.1. Altalix may refuse to enter into an Altalix Transaction with you at any time and for any reason.

6.2. Altalix provides virtual receipts for successful Altalix Transactions, which are accessible on the Altalix Dashboard.

6.3. Altalix will not and is under no obligation to provide you with a physical receipt or other written confirmation in connection with any Altalix Transaction.

6.4. Altalix is not a custodian or cryptocurrencies. If more thorough KYC or AML checks are deemed necessarily with respect to Altalix protocols, Your transaction’s execution and settlement may be delayed. During this period of delay, You will be exposed to and incur any move in rates.

Section 7: Identity Verification

7.1. You agree to cooperate with all requests made by Altalix or any of Altalix’s third party service providers on our behalf in connection with your Altalix Account, to identify or authenticate Your identity or to validate Your funding sources or Altalix Transactions. This includes, but is not limited to, requesting further information from You that will allow Altalix to reasonably identify You. This may include requiring You to take steps to confirm ownership of Your phone number or payment instruments or verifying Your Information and/or details against third party databases or through other sources.

7.2. Altalix reserves the right to close, suspend, or limit access to Your Altalix Account and/or the Altalix Services in the event we are unable to obtain, verify such Information or You fail to comply with our requests under 7.1 of these Terms.

7.3. Altalix may confidentially verify the information You provide or obtain information on you ourselves or through third parties from secure databases. Some of the searches which Altalix or a third party may perform, such as a credit check, may leave a soft footprint on your credit history. This will not affect your credit rating. By accepting these Terms, You confirm that You consent to us or a third party on our behalf carrying out such verifications.

7.4. You must ensure that all information on your Altalix Account is always accurate and up to date. If at any time we believe that Your information is outdated or inaccurate, we may contact You and request further information or request that You repeat the verification process. Your Altalix Transaction Limit will be adjusted accordingly while we verify Your identify. Altalix shall not be liable for any losses arising out of Your failure to maintain up to date information.

Section 8: Topping-up Your Altalix Account

8.1. In order to Top-Up Your Altalix Account, You will need to perform a Top-Up via a User Bank Transfer or via a Stored Card.

8.2. You will only be permitted to Top-Up from a User Bank Account or Stored Card held in Your own name, matching the details of the Altalix Account details.

8.3. Altalix may, with reasonable discretion (for example, without limitation, to limit fraud or credit risk), impose limits on the amount of money You can receive through Altalix Services. In order to increase your receiving limit, You must provide all supplemental information requested. If You have a Top-Up limit on your Altalix Account, You may be able to view it by logging onto your Altalix Dashboard and accessing the Profile section.

8.4. In order to perform a User Bank Transfer within the Altalix Dashboard, You are required to add and verify Your bank account (and subject to the terms of the bank mandate used by your bank to set up and maintain the authority), You provide us with a continuous authority to perform the User Bank Transfer and automatically charge Your bank account to Top Up your Altalix Account. Only named holders of the bank account can add the details to the Altalix Dashboard and the bank account must be in Your own name, matching Your Altalix Account profile.

8.5. If You perform a Top Up via a User Bank Transfer which is activated within the Altalix Dashboard and it is not completed due to insufficient or uncollected funds, You are obligated to reimburse Altalix for the value of the User Bank Transfer. To reclaim the amount owed to us under this Clause 8.5, Altalix may exercise its right to set-off, pursuant to Clause 12.1.

8.6. You can, at any time, cancel the bank mandate required to perform a User Bank Transfer within the Altalix Dashboard and withdraw your authorisation under Clause 8.4, by contacting us at support@altalix.com or writing to your bank or building society. If you cancel or withdraw your authorisation under this Clause 8.6, Altalix reserves the right to recover any outstanding or pending funds, pursuant to Clause 11.1.

8.7. Upon Altalix’s receipt of the funds sent via User Bank Transfer (either performed within or outside of the Altalix Dashboard), Altalix will allocate the corresponding sum to Your Altalix Account. The details of the bank account, belonging to Altalix, to send the money to will be set out on the Altalix Dashboard. It is Your responsibility to enter the correct bank account details when performing the User Bank Transfer and ensure that the money reaches us. If Altalix receives Your money in a currency other than the one You indicated to us when we provided You with the bank account details, then Altalix will not be liable for any losses that You may incur if our bank performs a currency conversion to change the money received into the currency of our bank account to which the money was sent.

8.8. In order to Top-Up via a Stored Card, You will need to add the details of the Stored Card onto your Altalix Dashboard. You may only add details of Your Stored Cards to your Altalix Dashboard if you are the named holder of Stored Card.

8.9. You have the option of activating and using the automatic Top-Up function. You can set up or cancel this function at any time using the Altalix Dashboard. The automatic Top-Up function allows You to automatically Top-Up your Altalix Account if the balance of your Altalix Account drops below a certain amount, which You must set on the Altalix Dashboard. The Top-Up will use Your selected Stored Card, when You enable the automatic Top-Up function. It is Your responsibility to ensure that there are sufficient funds available for the Top-Up in the account Your Stored Card is linked to.

Section 9: Altalix Transactions and Limits

9.1. Altalix Dashboard Transactions include but may not be limited to the following:

  1. “Wallet Top up” is the deposit of funds into the custody of Altalix and can only be done from a bank account in Your Own and Sole name;

  2. “Altalix Bank Transfer” – this means Altalix redeeming funds in Your Altalix Account, with or without a corresponding Monetary Exchange taking place, and transferring the equivalent sum to Your own Counterparty Bank Account; and

  3. “Altalix Cryptocurrency Purchase” – this is a purchase of cryptocurrency via the execution platform accessed through the Altalix Dashboard. Altalix is NOT a custodian of cryptocurrency and will deliver the cryptocurrency proceeds to the public key You have submitted (please see 15.2.2) or that provided by a the Third Party Provider from whose platform You chose to access Your Altalix account (please see 5.2 and 5.3). Altalix will only interact with public keys that have Altalix has approved. This Altalix Service is accessible via Your Account balance debit or card payment, from a card in Your own name. Please ensure that You have read and understood Section 15 on Cryptocurrency Services before using any corresponding service.

9.2. Altalix may refuse to enter into an Altalix Transaction with you at any time and for any reason.

9.3. Altalix Transaction Limits:

  1. Altalix reserves the right to impose with sole discretion Altalix Transaction Limits, based on criteria determined by Altalix and under no obligation to disclose.

  2. You may be able to view some of these Altalix Transaction Limits by logging onto the Altalix Dashboard. Altalix may, from time to time, provide you with procedures or methods to remove or increase such limits. We reserve the right to remove Altalix Transaction Limits from the Altalix Dashboard.

Section 10: Legitimate Use of the Altalix Services

10.1. Altalix does NOT permit You:

  1. directly or indirect to use the Altalix Services for any illegal purposes, including, but not limited to fraud and money laundering, unlawful sexually oriented materials or services, counterfeit products, unlawful gambling activities, fraud, money laundering, the funding of terrorist organizations, the unlawful purchase or sale of tobacco, firearms, prescription drugs, other controlled substances or other products prohibited by law. Altalix will report any suspicious activity and cooperate with any relevant law enforcement agency or regulator;

  2. to use the Altalix Services to abuse, exploit or circumvent the usage restrictions imposed by a merchant on the services it provides, or to obtain goods or services without paying the amount due partially or in full;

  3. directly or indirectly to procure any goods and/or services from dark web marketplaces;

  4. to breach these Terms, the Altalix Cardholder Terms (as applicable) or any other agreement or policy that you have agreed with Altalix or with Altalix (acting as Card Issuer);

  5. to create more than one Altalix Account without our express approval;

  6. to use the Altalix Services to violate any law, statute, ordinance, or regulation;

  7. to use directly or indirectly the Altalix Services for any illegal purposes including the purchase or sale, or the facilitation of the purchase or sale of, illegal goods or services;

  8. to use the Altalix Services to conduct activities pertaining to Altalix unapproved adult entertainment/pornography, auction houses, charities, chemicals and allied products, dating and escort services, binary options, legal services, political or religious organisations, video game arcades or establishments and business claiming to trade in prime bank guarantees, debentures, letters of credit or medium term notes;

  9. to infringe Altalix’s or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy;

  10. act in a manner that is defamatory, libellous, threatening or harassing when using the Altalix Services;

  11. to provide Altalix with false, inaccurate or misleading information;

  12. to use the Altalix Services to engage in debt-collection activities;

  13. to instruct us to send or receive what we reasonably believe to be potentially fraudulent funds on your behalf;

  14. to attempt to intentionally or knowingly receive or attempt to receive funds from both Altalix and a merchant for the same Altalix Transaction;

  15. to control an Altalix Account that is linked to another Altalix Account that has engaged in any of these Restricted Activities;

  16. to conduct Your business or use the Altalix Services in a manner that is likely to result in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties or other liability to Altalix, other Users, third parties or Youself;

  17. to use your Altalix Account or the Altalix Services in a manner that Altalix (acting as Card Issuer), Visa, MasterCard, American Express, Discover or any other funds transfer network reasonably believes to be an abuse of the card system or a violation of card association or network rules;

  18. to allow any of the currencies in your Altalix Account to have a negative balance;

  19. to provide Yourself with a cash advance from your credit card (or help others to do so);

  20. to take any action whatsoever that imposes an unreasonable or disproportionately large load on our infrastructure; facilitate any viruses, Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; use an anonymizing proxy; use any robot, spider, other automatic device, or manual process to monitor or copy our Website without our prior written permission; or interfere or attempt to interfere with the Altalix Services;

  21. to take any action that may cause us to lose any of the services from our Internet service providers, payment processors, or other suppliers;

  22. to use the Altalix Services to test credit card behaviours;

  23. to circumvent any Altalix policy or determinations about Your Altalix Account including, but not limited to, attempting to create a new or additional Altalix Account when a Altalix Account has a negative balance or has been restricted, suspended or otherwise limited; creating new or additional Altalix Accounts using Information that is not your own (e.g. name, address, email address, etc.); or using someone else’s Altalix Account;

  24. to harass Altalix staff, agents, or other Users;

  25. to refuse to cooperate in an investigation or provide confirmation of your identity or any Information you provide to us;

  26. to use the Altalix Services in a manner that we reasonably believe may be a violation of any applicable payment network rules, card association or network rules, or applicable law;

  27. to Altalix Services for any market speculation or arbitrage;

  28. to refuse or fail to provide further information about you or your business activities that we may reasonably request;

  29. without approval to conduct Your business or use the Altalix Services in a manner that leads us to receive a disproportionate number of claims or chargebacks;

  30. to have a credit score provided by a third party provider of Altalix’s choosing which indicates a higher level of risk associated with your use of the Services;

  31. to allow any other person access to your Altalix Account; and

  32. to reveal your Mobile PIN or Card PIN to anyone or use anyone else’s Mobile App or Altalix Card.

10.2. You must ensure that you only enter into Altalix Transactions relating to the sale or supply of goods and services in compliance with all applicable laws and regulations. The fact that a person or entity accepts payments via an Altalix Transaction is not an indication of the legality of the supply or provision of the goods and services.

10.3. Altalix reserves the right to refuse to perform an Altalix Transaction directly or indirectly associated with any Restricted Country.

10.4. If Altalix, in its sole discretion, believes that you may have breached the provision of this Clause, we may take action to protect ourselves, other Users and third parties. The action we may take includes but is not limited to:

  1. closing, suspending, or limiting your access to your Altalix Account or any or all of the Altalix Services;

  2. contacting other Users who have transacted with you; contacting your bank or credit card issuer; and/or warning other Users, law enforcement, or impacted third parties of your actions;

  3. updating inaccurate Information you have provided to us;

  4. taking legal action against You;

  5. terminating these Terms and Conditions or access to the Website and/or Altalix Dashboard;

  6. fully or partially reversing Altalix Transactions; and/or

  7. blocking Your access to your Altalix Account and/or Altalix Dashboard temporarily or permanently.

10.5. Where possible, Altalix will provide You with the relevant information regarding the actions imposed, but we may be unable to do so in accordance with the appropriate law including avoiding disclosing protected third party information or interfering in the course of an investigation.

Section 11: Suspending Your Use of Altalix Services

11.1. Altalix reserves the right to change, suspend or discontinue any feature of the Altalix Services at any time, including hours of operation or availability of the Altalix Services or any Altalix Services feature, without notice and without liability.

Section 12: Altalix Right to Set-Off

12.1. On occurrence of any event which entitles Altalix to be compensated by You (including, but not limited to, any technical errors on our behalf or on behalf of our third-party providers), Altalix is entitled to recover any sum due by retaining part or all of any sum that you have lodged with Altalix under any Altalix Transaction or otherwise. You shall have no similar right of set-off. For the avoidance of doubt, this includes the instance where one of the currency balances in your Altalix Account shows that you owe Altalix a sum for any reason or has a negative balance, Altalix may set-off the amount you owe by using funds You maintain in that currency or in a different currency balance or by deducting amounts You owe Altalix from money you receive into your Altalix Account, or money you attempt to withdraw or send from your Altalix Account, or in a different Altalix Account which you control and by deducting funds from any withdrawals you attempt to make.

Section 13: Your Balance and Negative Balances

13.1. You acknowledge that balances and available funds reported on the Altalix Dashboard are only approximate real time balances rather than the settled balances in Your Altalix Account. A real time balance may not account for pending debits and credits. Altalix will provide you with information on pending debits and credits as soon as it has that information.

13.2. If for any reason (including, but not limited to, any technical errors on our behalf or on behalf of our third-party providers) you have a negative balance in your Altalix Account, you agree to immediately Top-Up the required amount to correct the negative balance, such amounts being due without the need for previous notification. If you fail to do so Altalix may:

  1. exercise its right of set-off in accordance with Clause 12.1 of these Terms;

  2. initiate a chargeback procedure for any specific transaction which led to your Altalix Account having a negative balance;

  3. take debt collection measures including but not limited to mandating a debt collection agency or solicitors or to pursue the claim in court. Altalix reserves the right to charge you the expenses it reasonably incurs in connection with any debt collection or enforcement efforts; and/or

  4. requests that You complete a Top-Up in order to correct a negative balance. If You fail to do so within 7 Business Days, You authorise Altalix to initiate a payment transaction for the amount of the negative balance (or the equivalent in another currency) from one of your Stored Cards or User Bank Accounts.

Section 14: Security

14.1. It is Your responsibility to ensure that You take all reasonable steps to:

  1. keep Your Altalix password secret and secure, not sharing it with anyone and not writing it down;

  2. keep Your Mobile and Mobile PIN safe and secure;

  3. secure and maintain safe access to Your Altalix Dashboard; and

  4. keep Your Altalix Card PIN and other unique numbers (including CVC, expiry and card number) safe and secure.

14.2. The requirement in Clause 14.1 includes but is not limited to You:

  1. closing (or logging out of) the Mobile App or WebApp every time you are not using it;

  2. keeping the Mobile you use to gain access to the Altalix Dashboard safe and secure and locked with a secure password or other security mechanism;

  3. not writing down or telling anyone your Altalix password or Mobile PIN;

  4. changing Your Mobile PIN regularly;

  5. if you receive any SMSs or emails, questionnaires, surveys, or other links that require you to provide your Mobile PIN, not providing your information and contacting our customer services team at support@altalix.com on the Altalix Dashboard;

  6. ensuring that the Mobile and e-mail account(s) you use to communicate with us are secure and only accessed by you, as the Mobile and e-mail address may be used to reset your Mobile PIN or to send information relating to the security of the Altalix Dashboard;

  7. if at any time you think that your Mobile PIN has been lost, stolen or any other person knows your Mobile PIN or anyone has access to your e-mail account or Mobile you use to communicate with us, informing customer services immediately at support@altalix.com on the Altalix Dashboard;

  8. keeping Your Altalix Card safe and secure;

  9. not writing down or telling anyone your Card PIN or details of the Altalix Card; and

  10. disabling Your Altalix Card via the Altalix Dashboard or otherwise reporting to us, at any time if you think the security of the Altalix Card is at risk, e.g, if it is lost or stolen.

14.3. All Altalix Transactions are processed by automated methods, and anyone who obtains access credentials to the Altalix Dashboard or access to an Altalix Card could use it to enter into Altalix Transactions without your permission. If you notice misuse, theft or unauthorised use of your Mobile, Altalix Card, Mobile PIN or Card PIN or any other activity that makes you suspicious, You must contact the customer services team and if possible enable the appropriate security features on the Mobile App. If You suspect identity theft or theft of funds, we suggest that you contact your local police as well.

Section 15: Cryptocurrency Services

NEITHER THE FINANCIAL OMBUDSMAN SERVICE NOR THE FINANCIAL SERVICES COMPENSATION SCHEME (FSCS) APPLY TO THE CRYPTOASSET SERVICES OFFERED BY ALTALIX LTD.

15.1. General Introduction to Cryptocurrency:

  1. The following Terms set out the basis on which Altalix will provide you with the option of gaining exposure to certain cryptocurrencies and accessing goods and/or services priced in cryptocurrency. Before You can engage in such activity You are required to read these Cryptocurrency Terms and the various associated risk warnings contained herein. By proceeding to use the Altalix Services, You accept and acknowledge the associated risks in dealing with cryptocurrencies and your agreement with these Cryptocurrency Terms.

  2. You acknowledge that The Financial Ombudsman Service does NOT cover the cryptocurrency activities carried out by Altalix Ltd.

  3. You acknowledge that the Cryptocurrency Services provided in relation to these Cryptocurrency Terms, as with the majority of cryptocurrency services across the world, are presently unregulated and in some Territories, are illegal.

  4. By using Altalix’s Cryptocurrency Services, you agree to be bound by and acknowledge and understand these Cryptocurrency Terms and the risks stated herein.

  5. If you do not accept these Cryptocurrency Terms you are not permitted to use our Cryptocurrency Services and must cease doing so immediately.

15.2. Risks associated to Cryptocurrency that You accept:

  1. Altalix is NOT a custodian of cryptocurrency so when cryptocurrency is sent to an external address, its safeguarding becomes Your responsibility. In the instance, where it is sent to a Third-Party Provider, Altalix accepts no responsibility for the performance of any such parties (see 5.2).

  2. Once cryptocurrency is purchased or a fiat to crypto payment is made, custody moves from Altalix to the recipient wallet or wallet provided and/or managed by a Third-Party Provider. Consequently, reversing transactions is in most instances impossible, this gives rise to an increase in fraud risk and an increase in operational risk. You accept this risk and commit to mitigating it by carefully checking crypto addresses.

  3. The trading and exchange of real or virtual currencies involves significant risk. Prices can and do fluctuate significantly on any given day. Due to such price fluctuations, you may increase or lose value in your digital assets at any given moment. Any currency – virtual or not – may be subject to large movements in value and may even become worthless. There is an inherent risk that losses will occur as a result of buying, selling or exchanging any cryptocurrency.

  4. Cryptocurrency exchanges also carry special risks not generally shared with official currencies or goods or commodities in a market. Unlike most currencies, which are backed by governments or other legal entities, or by commodities such as gold or silver, cryptocurrency is a unique type of currency, backed by technology and trust. There is no central bank that can take corrective measure to protect the value of cryptocurrency in a crisis, or issue more currency.

  5. The price or value of cryptocurrency can rapidly increase or decrease at any time and may even fall to zero. The risk of loss in trading or holding cryptocurrencies can be substantial and can result in the loss of Your entire exposure.

  6. There may be additional risks that we have not foreseen or identified in these Cryptocurrency Terms or our other risk warnings.

  7. You must cautiously assess whether your financial situation and tolerance for risk is appropriate for any form of exposure to cryptocurrencies.

  8. Our banking partners do not transfer cryptocurrencies, exchange cryptocurrencies, or provide any services in connection with cryptocurrencies.

  9. The information on the Website is provided for information purposes only and is not intended to be and does not constitute financial advice or any other advice. It is general in nature and not specific to you and it has not and is not an offer to buy or sell or a solicitation of an offer to buy or sell any security, product, service or investment, nor is it a recommendation, endorsement, or sponsorship of any security, company, or fund. Altalix is not responsible for any investment decision made by You. You are responsible for conducting your own research and before using the Altalix’s information to make any decision, you should undertake your own due diligence and seek independent advice from an appropriately qualified third party. The information provided on the Website or in any communication containing a link to the Website is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject Altalix or its Affiliates to any registration requirement within such jurisdiction or country.

  10. The failure of certain cryptocurrencies to pass Altalix’s suitability criteria does NOT constitute an endorsement of those which have done.

15.3. You agree that Altalix will run forensic pre-transaction as well as retrospective public key checks on your payer and payee addresses, for the purposes of Anti-Money Laundering and illegal activity monitoring.

16.1. If you'd just like to speak to someone about an issue that's concerning you, please contact us through the Altalix app or send an email to support@altalix.com. We can usually settle matters quickly through the app. You’ll probably need to give us the information below.

16.2. If you would like to make a formal complaint, please email us at complaints@altalix.com. We will investigate your complaint and respond by email. If we are unable to resolve it to your satisfaction, we will provide you the details of the appropriate independent body with whom you can escalate your complaint.
